网上惊现郭罗基以诺贝尔奖提名人自居，公开了他的一封致诺奖委员会的中英文提名信（http://www.hjclub.info/bbs/viewtopic.php?p=2800958）。以前只见过呼吁某人获得诺奖的公开信，但提名人用公开信的方式向诺奖委员会提名似乎还是绝无仅有的。

郭罗基在公开信中直接用了向诺奖委员会“提名”、“I am writing to you to nominate ……”，这和以前常见的诸如哈维尔等用的“We ask the Nobel Committee to honor……”，以及“呼吁提名”、“推动提名”、“请求评审委员会”等等显然不一样。

我在这里不讨论被郭罗基提名的人是否够资格获奖等等，而只是对郭罗基作为提名人的言行和资格提出以下质疑：

1）郭罗基具备诺奖提名人的资格么？

根据诺贝尔奖委员会网站上的信息：http://nobelprize.org/nobel_prizes/peace/nomination/index.html

诺奖委员会明确规定：
“Qualified Nominators

The right to submit proposals for the Nobel Peace Prize shall, by statute, be enjoyed by:

1. Members of national assemblies and governments of states;
2. Members of international courts;
3. University rectors; professors of social sciences, history, philosophy, law and theology; directors of peace research institutes and foreign policy institutes;
4. Persons who have been awarded the Nobel Peace Prize;
5. Board members of organizations who have been awarded the Nobel Peace Prize;
6. Active and former members of the Norwegian Nobel Committee; (proposals by members of the Committee to be submitted no later than at the first meeting of the Committee after February 1) and
7. Former advisers appointed by the Norwegian Nobel Institute.”

而郭罗基在“提名信”中的自我资格介绍（提名者还需要自我介绍资格？真奇怪）是这样的：

“My name is Luoji Guo. I was a professor of philosophy at Beijing University and at Nanjing University before I came to the United States in 1992. While still in China, I began serving as a board member of Human Rights in China, a New York based NGO promoting human rights in China. I was also elected an active member of the New York Academy of Sciences in 1992.

After coming to the United Sates, I held a number of academic positions. I was a Visiting Scholar and then a Senior Research Scholar at the East Asian Institute of Columbia University in New York from 1992 to 1995, and a Senior Research Fellow at Harvard Law School from 1995 to 2002. I have been Senior Research Fellow Emeritus at Harvard Law School since my retirement in 2002. ”

对照诺奖委员会的提名人资格要求，第一条、第二条、以及第四到第七条都与郭罗基无关。那么只有第三条——3. University rectors; professors of social sciences, history, philosophy, law and theology; directors of peace research institutes and foreign policy institutes——似乎与郭罗基有些联系。但这条所说的应该都是现职教授等，而郭罗基已经在2002年就退休了，早已不是正式的现职人员了。

再拿郭罗基自我介绍的退休前的学术地位Visiting Scholar 、Senior Research Fellow来说吧，它们属于University rectors、professors 、directors 中的哪一项？。据本人所知，Visiting Scholar 、Senior Research Fellow这些称谓对于在美国大学访问的大陆学者来说是很常见的，它们更像是一种客气的、荣誉性的称谓，并没有与正规的大学教授等相当的实际地位。于是令人不禁想问，郭罗基够资格作为诺奖正式邀请的提名人么？

2）郭罗基是被诺贝尔委员会正式邀请作为提名人的么？

诺奖委员会明确地说：“Every year, the Norwegian Nobel Committee sends out thousands of letters inviting qualified people to submit their nominations for the Nobel Peace Prize. ”

据此，诺贝尔奖提名人不是可以自称的，而是由诺奖委员会正式写信邀请的。但郭罗基在公开信中并没有说他是被邀请的提名人，那只能被认为是他自称的。

诺奖提名人是由诺奖委员会选择认定的，不是可以自我声称的。诺奖委员会每年要向他们选择认可的几千名提名人发出提名邀请函。而诺奖委员会之所以选择了某人作为提名人并给他发提名邀请函，必然是对此人已经有了一定的了解，这才认定了他。而郭罗基在他的所谓公开信里一开篇却是首先自我介绍，历数、罗列自己的学术地位。这无疑显示出，他认为诺奖委员会还不认识他，这才需要他把自己首先介绍给诺奖委员会。他这么做，倒像是象向诺奖委员会首先推荐自己，希望得到诺奖委员会的认可，而完全不像是一个已经得到了诺奖委员会选择认可的提名人。

3）诺奖提名人可以将提名信息公开么？

诺奖委员会明确严格地规定：“The statutes of the Nobel Foundation restrict disclosure of information about the nominations, whether publicly or privately, for 50 years. The restriction concerns the nominees and nominators, as well as investigations and opinions related to the award of a prize.”

诺贝尔和平奖委员会有明确的严格规定，不得将提名人、被提名人、以及相关资料公开，要保密50年。诺奖委员会既然有此严格规定，那么它每年选择的几千提名人也必然会知道并遵守这这一规定。首先这些提名人都是诺奖委员会选择认可的学术界、政界、司法界的名人，他们对自己的信誉是十分重视的，不会做出违反严格规定从而给自己的信誉带来极大损失的事。其次，也许诺奖委员会对选定的提名人在法律上有一定的约束，对违者予以法律追究。

而郭罗基的公开信却完全违背了这一严格要求，他那架势似乎是恨不得全世界的人都知道他是提名人，又提名了谁谁，并列举了那谁谁的主要贡献等等资料。郭罗基在西方学术机构里面呆过多年，并能用英文写信，他不像是个英文文盲。而他这么将明确规定了的不应该公开的资料全部公开，其唯一的合理解释只能是，他根本就没有收到过提名邀请函，不是诺奖委员会选择认可的提名人。因此他才会对人家的严格要求一无所知，干出这种完全不像是个严肃的学者却像是个粗鲁的莽汉才干得出的事。

4）郭罗基怎么会连提名的截止日期都不知道？

诺奖委员会明确规定：“February – Deadline for submission. The Committee bases its assessment on nominations that must be postmarked no later than 1 February each year. Nominations postmarked and received after this date are included in the following year's discussions. ”

而郭罗基的提名信的日期是九月三十日，距离提名截止日期已经晚了半年多了，如此违背常识的做法也太不正规了吧？而且郭罗基此信的写作日期距离公布获奖者名单还剩下短短的八天左右，此时的获奖者名单恐怕都已经初定下来了。即使收到郭罗基的信，但郭罗基是什么世界级的大名人大学者，他的信需要人家紧急特殊对待？郭罗基把世界第一大奖诺奖提名搞得如此仓促，是不是也太儿戏了些了？这也算是个严肃的学者的作为么？

总之，郭罗基的以上言行像是个被诺奖委员会正式邀请的提名人么？他有资格作为诺贝尔奖的提名人么？
