網上驚現郭羅基以諾貝爾獎提名人自居，公開了他的一封致諾獎委員會的中英文提名信（http://www.hjclub.info/bbs/viewtopic.php?p=2800958）。以前只見過呼籲某人獲得諾獎的公開信，但提名人用公開信的方式向諾獎委員會提名似乎還是絕無僅有的。

郭羅基在公開信中直接用了向諾獎委員會“提名”、“I am writing to you to nominate ……”，這和以前常見的諸如哈維爾等用的“We ask the Nobel Committee to honor……”，以及“呼籲提名”、“推動提名”、“請求評審委員會”等等顯然不一樣。

我在這裡不討論被郭羅基提名的人是否夠資格獲獎等等，而只是對郭羅基作為提名人的言行和資格提出以下質疑：

1）郭羅基具備諾獎提名人的資格麼？

根據諾貝爾獎委員會網站上的信息：http://nobelprize.org/nobel_prizes/peace/nomination/index.html

諾獎委員會明確規定：
“Qualified Nominators

The right to submit proposals for the Nobel Peace Prize shall, by statute, be enjoyed by:

1. Members of national assemblies and governments of states;
2. Members of international courts;
3. University rectors; professors of social sciences, history, philosophy, law and theology; directors of peace research institutes and foreign policy institutes;
4. Persons who have been awarded the Nobel Peace Prize;
5. Board members of organizations who have been awarded the Nobel Peace Prize;
6. Active and former members of the Norwegian Nobel Committee; (proposals by members of the Committee to be submitted no later than at the first meeting of the Committee after February 1) and
7. Former advisers appointed by the Norwegian Nobel Institute.”

而郭羅基在“提名信”中的自我資格介紹（提名者還需要自我介紹資格？真奇怪）是這樣的：

“My name is Luoji Guo. I was a professor of philosophy at Beijing University and at Nanjing University before I came to the United States in 1992. While still in China, I began serving as a board member of Human Rights in China, a New York based NGO promoting human rights in China. I was also elected an active member of the New York Academy of Sciences in 1992.

After coming to the United Sates, I held a number of academic positions. I was a Visiting Scholar and then a Senior Research Scholar at the East Asian Institute of Columbia University in New York from 1992 to 1995, and a Senior Research Fellow at Harvard Law School from 1995 to 2002. I have been Senior Research Fellow Emeritus at Harvard Law School since my retirement in 2002. ”

對照諾獎委員會的提名人資格要求，第一條、第二條、以及第四到第七條都與郭羅基無關。那麼只有第三條——3. University rectors; professors of social sciences, history, philosophy, law and theology; directors of peace research institutes and foreign policy institutes——似乎與郭羅基有些聯繫。但這條所說的應該都是現職教授等，而郭羅基已經在2002年就退休了，早已不是正式的現職人員了。

再拿郭羅基自我介紹的退休前的學術地位Visiting Scholar 、Senior Research Fellow來說吧，它們屬於University rectors、professors 、directors 中的哪一項？。據本人所知，Visiting Scholar 、Senior Research Fellow這些稱謂對於在美國大學訪問的大陸學者來說是很常見的，它們更像是一種客氣的、榮譽性的稱謂，並沒有與正規的大學教授等相當的實際地位。於是令人不禁想問，郭羅基夠資格作為諾獎正式邀請的提名人麼？

2）郭羅基是被諾貝爾委員會正式邀請作為提名人的麼？

諾獎委員會明確地說：“Every year, the Norwegian Nobel Committee sends out thousands of letters inviting qualified people to submit their nominations for the Nobel Peace Prize. ”

據此，諾貝爾獎提名人不是可以自稱的，而是由諾獎委員會正式寫信邀請的。但郭羅基在公開信中並沒有說他是被邀請的提名人，那只能被認為是他自稱的。

諾獎提名人是由諾獎委員會選擇認定的，不是可以自我聲稱的。諾獎委員會每年要向他們選擇認可的幾千名提名人發出提名邀請函。而諾獎委員會之所以選擇了某人作為提名人並給他發提名邀請函，必然是對此人已經有了一定的了解，這才認定了他。而郭羅基在他的所謂公開信里一開篇卻是首先自我介紹，歷數、羅列自己的學術地位。這無疑顯示出，他認為諾獎委員會還不認識他，這才需要他把自己首先介紹給諾獎委員會。他這麼做，倒像是象向諾獎委員會首先推薦自己，希望得到諾獎委員會的認可，而完全不像是一個已經得到了諾獎委員會選擇認可的提名人。

3）諾獎提名人可以將提名信息公開麼？

諾獎委員會明確嚴格地規定：“The statutes of the Nobel Foundation restrict disclosure of information about the nominations, whether publicly or privately, for 50 years. The restriction concerns the nominees and nominators, as well as investigations and opinions related to the award of a prize.”

諾貝爾和平獎委員會有明確的嚴格規定，不得將提名人、被提名人、以及相關資料公開，要保密50年。諾獎委員會既然有此嚴格規定，那麼它每年選擇的幾千提名人也必然會知道並遵守這這一規定。首先這些提名人都是諾獎委員會選擇認可的學術界、政界、司法界的名人，他們對自己的信譽是十分重視的，不會做出違反嚴格規定從而給自己的信譽帶來極大損失的事。其次，也許諾獎委員會對選定的提名人在法律上有一定的約束，對違者予以法律追究。

而郭羅基的公開信卻完全違背了這一嚴格要求，他那架勢似乎是恨不得全世界的人都知道他是提名人，又提名了誰誰，並列舉了那誰誰的主要貢獻等等資料。郭羅基在西方學術機構裡面呆過多年，並能用英文寫信，他不像是個英文文盲。而他這麼將明確規定了的不應該公開的資料全部公開，其唯一的合理解釋只能是，他根本就沒有收到過提名邀請函，不是諾獎委員會選擇認可的提名人。因此他才會對人家的嚴格要求一無所知，干出這種完全不像是個嚴肅的學者卻像是個粗魯的莽漢才幹得出的事。

4）郭羅基怎麼會連提名的截止日期都不知道？

諾獎委員會明確規定：“February – Deadline for submission. The Committee bases its assessment on nominations that must be postmarked no later than 1 February each year. Nominations postmarked and received after this date are included in the following year's discussions. ”

而郭羅基的提名信的日期是九月三十日，距離提名截止日期已經晚了半年多了，如此違背常識的做法也太不正規了吧？而且郭羅基此信的寫作日期距離公布獲獎者名單還剩下短短的八天左右，此時的獲獎者名單恐怕都已經初定下來了。即使收到郭羅基的信，但郭羅基是什麼世界級的大名人大學者，他的信需要人家緊急特殊對待？郭羅基把世界第一大獎諾獎提名搞得如此倉促，是不是也太兒戲了些了？這也算是個嚴肅的學者的作為麼？

總之，郭羅基的以上言行像是個被諾獎委員會正式邀請的提名人麼？他有資格作為諾貝爾獎的提名人麼？
