In a class action, usually Plaintiff does not expect to win the lawsuit. Rather as long as it can survive all of Defendant's motions for dismissal on procedural grounds and motion for summary judgment, it would almost certainly be a settlement. This is so simply because the cost/benefit analysis will be in Defendant's favor if it goes to trial. Almost all the lawyers representing Plaintiffs in class actions are on a contingent fee basis, which means they will not charge anything unless they get something out of the lawsuit. Those lawyers often are the sources of public bias against otherwise a very professional group of people.
