7月5日日本提案和7月15日安理會決議之分析

7月5日日本提案和7月15日安理會決議分為兩部分,第一部分是對過去決議、事件回顧及對當前事件的關心,第二部分涉及各國應該採取的行動。

這裡關鍵的是第二部分,也就是行動部分,其中包括譴責和制裁。


行動細則:

提案:Op1. Condemns the launches by the DPRK of a ballistic missiles on 5 July 2006;

決議: 1. Condemns the multiple launches by the DPRK of ballistic missiles on 5 July 2006 local time;

決議與提案一致,此條為譴責條款。

提案:Op2. Decides that the DPRK shall immediately cease the development, testing, deployment and proliferation of ballistic missiles and reconfirm its moratorium on missile launching;

決議: 2. Demands that the DPRK suspend all activities related to its ballistic missile programme, and in this context re-establish its pre-existing commitments to a moratorium on missile launching;

決議與提案用詞有變化,實際要求一致。此條以命令的口氣對北朝鮮提出要求,為日後北朝鮮不遵守決議而產生的其它行動打開了通路。

提案:Op3. Decides that Member States shall prevent the transfer of financial resources, items, materials, good and technology to end users that could contribute to DPRK's missile and other WMD programmes;

決議:
3. Requires all Member States, in accordance with their national legal authorities and legislation and consistent with international law, to exercise vigilance and prevent missile and missile-related items, materials, goods and technology being transferred to DPRK's missile or WMD programmes;

4. Requires all Member States, in accordance with their national legal authorities and legislation and consistent with international law, to exercise vigilance and prevent the procurement of missiles or missile related-items, materials, goods and technology from the DPRK, and the transfer of any financial resources in relation to DPRK's missile or WMD programmes;

決議把提案分為兩段,特別增加了控制北朝鮮輸出技術的條款,比提案更為細緻和嚴厲。這兩條是明白無誤的制裁條款,制裁對象不僅包括了北朝鮮,也可以日後涉及任何與北朝鮮進行導彈、核武器合作的國家。也就是說,與各位憤青酸溜溜地辯護有所不同,聯合國決議不僅有譴責,也包括了制裁。

提案:Op4. Strongly urges the DPRK to immediately return to the Six-Party Talks without precondition, to work toward the expeditious implementation of September 19 2005 Joint Statement, and to cease all work on nuclear-related activities with the aim of the complete, verifiable, and irreversible dismantlement of all DPRK nuclear program.

決議:
6. Strongly urges the DPRK to return immediately to the Six-Party Talks without precondition, to work towards the expeditious implementation of 19 September 2005 Joint Statement, in particular to abandon all nuclear weapons and existing nuclear programmes, and to return at an early date to the Treaty on Non-Proliferation of Nuclear Weapons and International Atomic Energy Agency safeguards;

決議和提案大致相同。

除了原提案已有項目外,決議更增加了以下幾條:

5. Underlines, in particular to the DPRK, the need to show restraint and refrain from any action that might aggravate tension, and to continue to work on the resolution of non-proliferation concerns through political and diplomatic efforts;

7. Supports the six-party talks, calls for their early resumption, and urges all the participants to intensify their efforts on the full implementation of the 19 September 2005 Joint Statement with a view to achieving the verifiable denuclearization of the Korean Peninsula in a peaceful manner and to maintaining peace and stability on the Korean Peninsula and in north-east Asia;

8. Decides to remain seized of the matter.

在行動綱領中,決議唯一比提案有所妥協的,也是報導中所提到的是此前提:

提案:Acting under Chapter VII of the Charter of the United Nations,

決議:Acting under its special responsibility for the maintenance of international peace and security.

這是各方都能接受的語言,應該知道無論用什麼語言,蘇中並不會打北朝鮮。世界上真正有能力和有意願對北韓進行武力制裁的只有美、日。聯合國表決後,美、日、英、法已經宣稱即使不提及聯合國第7章,此決議也是強制行的。美國駐聯合國大使也宣稱決議使用了“命令”和“要求”字樣,已經成為執法條例(legally binding)。
