For those not familiar, David Kallman of the Great Lakes Justice Center filed an injunction to stop the certification of the ballots due to the problems in Wayne County. Obviously they were “certified” yesterday. But, the Michigan SC listened to the evidence and gave an opinion. The key thing is that first you have justices saying that THERE IS EVIDENCE of FRAUD and that CERTIFICATION DOES NOT PRECLUDE A RESULTS AUDIT!!!
HIGHLIGHTS OF OPINION
-Not precluded from seeking results audit under the constitution
-Nothing ruled diminishes the troubling/serious allegations of fraud and ballot irregularity
-Plaintiffs affidavits present EVIDENCE to SUBSTANTIATE ALLEGATIONS including: claims of ballots by voters not in poll books, instructions to disobey election laws, questionable appearance of unsecured absentee ballots after time period, discriminatory conduct
-Trial court should hold IMMEDIATE EVIDENTIARY HEARING
Highlights:
-Former Michigan Assistant AG - Ballots not assigned to right voters
-Former Michigan Secretary of State filed affidavit
-Justices make it clear that an audit is not precluded by certification from yesterday
-Encouraged to go back to Trial Court for Evidentiary Hearing
