致全球每個人的信(6):看一位中國前法官花了二十多年時間給北京寫信的故事,以及他最終想告訴全人類什麼(This letter is followed by a text translated into English using online resources. Please refer to the Chinese text of this letter while reading it.) ——作者:金穀雨 如果有人告訴你: 有一位中國前法官,從1997年第一次向北京寫信。並於1999年開始連年每年屢屢地持續寫信。 二十多年間,他通過郵政、網絡、信訪、舉報、研究報告、法律分析和理論解析文章等方式,向中國各級機構乃至中共中央發出了超萬份材料。 他反覆追問的,並不是自己的待遇問題,也不是個人恩怨。 他一直在追問一個看似簡單的問題: 為什麼法律與制度規則條文都明明存在且清楚無異議,卻仍然可能失效? 你或許會覺得,這是一個只與中國有關的問題。 但如果你願意再往前想一步,就會發現: 這其實也是一個與所有國家、所有社會、所有人都有關的問題。 因為當法律失效時,受損的不僅是法律本身。 當制度失效時,受損的不僅是制度本身。 當程序失效時,受損的不僅是程序本身。 最終受損的,是人與人之間的信任,是社會合作的基礎,是文明賴以存在的秩序。 而這,正是我二十多年持續寫信、思考和研究後,越來越想告訴全人類的一件事。 我的思考並不是從哲學開始的。 恰恰相反。 它開始於一個非常具體的司法案件。 1997年,我接觸到一起司法執行案件。 案件本身並不複雜。 複雜的是,它讓我第一次意識到: 即使法律條文已經寫得十分清楚,現實中的法律運行卻並不一定按照法律條文的邏輯展開。 後來,我又親身經歷和接觸到一些更加複雜的案件。 特別是在2012年前後,一起涉及地方權力、司法程序和中央政令貫徹的問題,讓我進一步意識到: 很多時候,人們以為問題出在法律或制度本身。 但真正的問題,可能出在法律與制度之外。 問題出在制度運行過程中那些看不見、卻決定着制度運行能精準維持預定結果的程序。 也正是從那時開始,我逐漸意識到: 我所在各種案件中面對的,也許已經不是一個案件的問題。 甚至不僅僅是中國的問題。 而是一個關於人類文明如何運轉的問題。 為什麼有些制度相對穩定的期限會雖然較長,卻也坎坷跌宕?且現在普遍前景堪憂? 為什麼人類各種制度都會不斷失靈? 為什麼人類科技越來越先進,社會卻依然充滿衝突? 為什麼人類創造了前所未有的財富,卻始終無法擺脫戰爭、恐懼、焦慮和內耗? 為什麼每一個人都希望獲得幸福,而整個人類卻總是在重複製造苦難? 為什麼任何人不管為公還是為私,做什麼都艱難? 這些問題,看起來彼此無關。 但在長期思考之後,我逐漸懷疑: 它們背後可能存在同一個根源。 二十多年來,我不斷向北京寫信。 最初,我只是希望有人能夠認真審查案件。 後來,我希望有人能夠認真討論支撐制度穩定可持續的基礎。 再後來,我希望有人能夠認真思考文明的本質及其演繹規律。 但隨着時間推移,我逐漸意識到: 如果人類始終站在物質主義視角,沿用同樣的思維方式觀察世界,那麼即使解決一個案件,也會從這個看似被解決的案件中滋生出現新的案件;即使解決一個問題,甚至會弄出更複雜的新的問題。這些威脅人類社會合作鏈接可持續的問題,總是剪不斷理還亂。推而審視整個人類文明史,即使探索再多的新制度,也兜不住社會穩定的底線,解決不了文明步伐一直踉蹌難行的問題,更不可能阻止現在的人類繼續茫然不斷加速奔向全部被自我毀滅的命運。 於是我的思考開始超出司法和法律的範圍。 我開始嘗試從更大的尺度去理解: 文明本質是什麼?為什麼會形成? 文明為什麼會失序? 被人類區分的各種文明是否存在某種共同規律? 如果存在,人類是否能夠找到一種比現有各類社會合作模式更加穩定、更加可持續的發展道路?文明是宇宙能量運動生發出來的一種現象,那麼,文明的穩定可持續是不是能從解析人類社會合作結構及其運轉機制中得到答案? 我已經發在網絡上的《致全球每個人的信(5):人類想永久和平再無苦難就只需努力傳遞此信息促成一次國際會議後必能實現》及其提到的相關文章,正是在這樣的背景下寫成的。 我知道,裡面提出的一些觀點會讓許多人感到陌生。 甚至可能有人會覺得荒謬。 但是這裡追問的,是從法律到程序、合作、秩序與文明及其演繹規律和人類做好文明這件事的具體實施抓手之間更深層的關聯。 我並不要求任何人接受我的結論。 我也不要求任何人相信我的判斷。 我更不要求任何人因為我的經歷而同情我。 我唯一希望的是: 請先放下贊成與反對。 像審視一個陌生的問題那樣,審視這篇文章。 然後思考幾個簡單的問題: 為什麼一個人會花二十多年時間持續追問同一個問題? 究竟是什麼力量讓他堅持到今天? 如果這些問題真的毫無意義,他為什麼沒有放棄? 而如果這些問題有意義,那麼它們究竟指向什麼? 我始終相信: 對於人類而言,最危險的從來不是錯誤答案。 而是從來沒有認真提出過正確的問題。 因此,我希望《致全球每個人的信(5):人類想永久和平再無苦難就只需努力傳遞此信息促成一次國際會議後必能實現》能夠被更多人看到。 不是因為我是誰。 而是因為我希望全人類能夠共同討論: 在人類文明走到今天這個階段的時候,我們是否仍然因視而不見導致遺漏了某個最基礎、最重要的問題?所以,因基礎的不穩定可持續,才導致人類用各種方法蓋人類社會合作大廈結構的鏈接總是斷裂而都蓋不了多高就倒塌。 如果答案是“是”,那麼現在也許正是重新開始思考的時候。因此,希望更多的人重視並理解我關於人類需要召開一次國際會議的呼籲。我的觀點是:人類需要從宇宙視角來建立一種新的文明理論框架;如果能召開一次國際會議使人類精英們能夠圍繞這一問題進行認真討論,也許有可能找到實現世界持久和平的新路徑。這應該就是人類開始走向永久和平的起點。
這,就是我寫這封信的原因。 最後,再簡述我認為我的系列文章提出的程序定質規律在現實與歷史中的適用性。我認為,程序定質規律,是任何人想做任何事都能順暢百靈的“自然法則總開關”,而且這個總開關就一直攥在每一個人的手中,只是因為所有人都站在物質主義立場來看問題,所以才將這個總開關用顛倒了,只有在與“自然法則總開關”規則衝突中被偶然矯正的時候人類才會取得文明成果。所以,對於文章將宇宙本體論 、程序哲學 、法律程序 、國家治理 、社會合作 、AI風險 、世界和平等串起來綜合講,是因為人類需要重構全新的文明本質及其演繹規律的認知理論框架。而要讓人們在現在的思維模式中真正理解全新的文明認知理論框架,並認識到這裡闡釋的“自然法則總開關”是任何人只要努力就能掌握與正確運用的,最佳方式是能結合任何具體文明演繹故事來解析其中演繹的具體機制,就會讓任何人都很容易理解。 總之文章所述的哲學理論,是能實際應用的抓手。只是鑑於境況,我無法結合實際來具體解析,以清晰展示人類是怎樣將“自然法則總開關”抓亂導致人類一切亂象叢生的。如果還有機會,能擺脫各種纏繞,有時間在一個能安全地好好說話的平台,我將從我所看到的視角,坦誠地講出我經歷的真實故事。並願意傾聽所有人的故事,與所有願意好好說話的人討論任何文明的疑問........, 或許這樣我還能為文明未來做點有實效的事。 本信不長,所以通過網絡幫助已將中文文本翻譯成英文本,同文發表。非常希望有緣閱讀的人,能將本信譯成各種文字並傳遞給各媒體傳播,或交給各政府政要及各人類精英,以便促成一次國際會議,來討論文明的本質及其社會合作結構和演繹規律這個課題,開啟人類走向世界永久和平之啟動程序。 Letter to Every Person on Earth (6)The Story of a Former Chinese Judge Who Spent More Than Twenty Years Writing to Beijing — and What He Ultimately Wants to Tell Humanity——Author: Jin Guyu If someone told you that there was once a Chinese judge who first wrote to Beijing in 1997, and who, beginning in 1999, continued writing year after year, again and again, for more than two decades, you might wonder why. Over the course of more than two decades, he submitted more than 10,000 letters, petitions, complaints, research papers, legal analyses, and theoretical essays through every available official channel—from postal mail and online submissions to China's petition system—addressed to government bodies at every level, including the Central Committee of the Communist Party of China. What he kept asking about was not his personal treatment, nor a private grievance. He was pursuing a question that appears simple: Why do laws, institutions, and written rules sometimes fail in practice, even when they clearly exist and their meaning seems beyond dispute? You may think this is a question that concerns China alone. But if you take one more step in thought, you may see that it is in fact a question concerning every country, every society, and every human being. When law fails, it is not only law itself that is damaged. When institutions fail, it is not only institutions themselves that are damaged. When procedure fails, it is not only procedure itself that is damaged. What is ultimately harmed is trust between human beings, the foundation of social cooperation, and the order upon which civilization depends. This is what I have increasingly wanted to tell all humanity after more than twenty years of writing, thinking, and research. My thinking did not begin with philosophy. On the contrary, it began with a very specific judicial case. In 1997, I became involved in a judicial enforcement case. The case itself was not complicated. What was complicated was that it made me realize, for the first time, that even when legal provisions are written clearly, the real operation of law does not necessarily follow the logic of the written law. Later, I personally experienced and encountered more complicated cases. In particular, around 2012, a case involving local power, judicial procedure, and the implementation of central government policy made me realize something further. Very often, people assume that the problem lies in law or institutions themselves. But the real problem may lie outside law and institutions. It may lie in those invisible procedures within the operation of institutions — procedures that determine whether an institution can accurately maintain its intended outcome. From that time on, I gradually realized that what I was facing in these cases might no longer be merely a question of one case. It might not even be merely a question of China. It might be a question about how human civilization itself operates. Why can some institutions remain relatively stable for a longer period, yet still go through repeated turbulence, and why do their prospects now seem widely troubling? Why do all kinds of human institutions repeatedly fail? Why does human technology become more and more advanced, while society remains full of conflict? Why has humanity created unprecedented wealth, yet still cannot escape war, fear, anxiety, and internal exhaustion? Why does every individual hope for happiness, while humanity as a whole continues to reproduce suffering? Why is it so difficult for anyone to do anything, whether for public purposes or private purposes? These questions may appear unrelated. But after long reflection, I gradually came to suspect that they may share the same root. For more than twenty years, I continued writing to Beijing. At first, I simply hoped that someone would seriously review the cases. Later, I hoped that someone would seriously discuss the foundations that allow institutions to remain stable and sustainable. Still later, I hoped that someone would seriously reflect on the nature of civilization and the laws by which it evolves. But as time passed, I gradually realized something else. If human beings continue to stand within a materialist perspective and observe the world through the same mode of thinking, then even if one case is solved, new cases may grow out of the very case that appeared to have been solved. Even if one problem is solved, more complex new problems may be created. These problems threaten the sustainability of the links that hold human social cooperation together; they are tangled and difficult to cut through. Looking at the entire history of human civilization in this light, even if humanity explores ever more new systems, it still cannot secure the bottom line of social stability. It cannot solve the problem that the steps of civilization have always been stumbling and difficult. Still less can it prevent present-day humanity from continuing blindly and ever more rapidly toward a fate of self-destruction. Thus my thinking began to move beyond the scope of judiciary and law. I began to try to understand, from a broader scale: What is the nature of civilization? Why does civilization form? Why does civilization fall into disorder? Do the various civilizations distinguished by human beings share some common law? If so, can humanity find a path of development that is more stable and more sustainable than the existing forms of social cooperation? If civilization is a phenomenon generated by the movement of cosmic energy, then can the answer to its stability and sustainability be found by analyzing the structure and operating mechanism of human social cooperation? My article already published online, “Letter to Every Person on Earth (5): If Humanity Wants Lasting Peace and an End to Suffering, It Need Only Spread This Message and Help Bring About One International Conference,” together with the related writings mentioned in it, was written against this background. I know that some of the views expressed there will feel unfamiliar to many people. Some may even find them absurd. But what is being pursued there is a deeper connection — from law to procedure, cooperation, order, civilization, the laws by which civilization evolves, and the practical means by which humanity can do civilization well. I do not ask anyone to accept my conclusions. I do not ask anyone to believe my judgments. Still less do I ask anyone to sympathize with me because of my personal experience. My only hope is this: Please first put aside agreement and disagreement. Examine this article as you would examine an unfamiliar question. Then consider several simple questions: Why would one person spend more than twenty years continuously pursuing the same question? What force has kept him going until today? If these questions were truly meaningless, why did he not give up? And if these questions do have meaning, then what exactly do they point toward? I have always believed that, for humanity, the greatest danger is not a wrong answer. It is never having seriously raised the right question. Therefore, I hope that “Letter to Every Person on Earth (5): If Humanity Wants Lasting Peace and an End to Suffering, It Need Only Spread This Message and Help Bring About One International Conference” can be seen by more people. Not because of who I am. But because I hope all humanity can discuss this question together: At this stage of human civilization, have we perhaps failed to see — and therefore missed — some most basic and most important question? Is it because the foundation is not stable and sustainable that, no matter what methods humanity uses to build the great structure of human social cooperation, the links in that structure keep breaking, so that it collapses before it can rise very high? If the answer is yes, then perhaps now is the time to begin thinking again. For this reason, I hope more people will take seriously and understand my call for humanity to convene an international conference. My view is this: humanity needs to build a new theoretical framework for civilization from a cosmic perspective. If an international conference can be convened so that human elites may seriously discuss this question, it may be possible to find a new path toward lasting world peace. This should be the starting point from which humanity begins to move toward permanent peace. This is why I write this letter. Finally, I would like to briefly explain what I see as the applicability, in reality and history, of the principle proposed in my series of writings: the Principle That Process Determines Nature. In my view, this principle is the “master switch of natural law” that allows anyone, in doing anything, to act smoothly and effectively. Moreover, this master switch has always been held in each person’s own hands. It is only because everyone has been looking at problems from a materialist standpoint that this master switch has been used upside down. Humanity has achieved the fruits of civilization only when, in conflict with the rules of this “master switch of natural law,” it was accidentally corrected. Therefore, when my writings connect cosmic ontology, process philosophy, legal procedure, national governance, social cooperation, AI risk, and world peace, it is because humanity needs to reconstruct an entirely new theoretical framework for understanding the nature of civilization and the laws of its evolution. To help people truly understand this new theoretical framework within their present mode of thinking, and to recognize that “The Principle That Process Determines Properties”(PDP Principle——The properties of every perceivable entity are determined by the sustainability requirements of the internal processes through which its components are organized and cooperate.) explained here can be mastered and correctly used by anyone who makes the effort, the best method is to analyze the specific mechanisms at work in concrete stories of civilizational evolution. In this way, anyone can understand it much more easily. In short, the philosophical theory described in these writings is a practical tool that can be applied. However, because of my circumstances, I cannot yet combine it with real examples in a detailed way to clearly show how humanity has mishandled this “master switch of natural law,” thereby giving rise to all kinds of disorder. If I still have the opportunity, if I can free myself from various entanglements, and if I have time on a platform where people can speak safely and sincerely, I will honestly tell the true stories I have seen from my own perspective. I am also willing to listen to everyone’s stories and to discuss any questions about civilization with all those who are willing to speak in good faith. Perhaps in this way, I may still be able to do something of real value for the future of civilization. This letter is not long.
