Based on your reasoning, it should be OK to harass someone over the phone, or via email. But I wouldn't just take your advise and do it yet.

The crux of harassment is how the recipient of such actions feel. Of course you need to prove that any reasonably minded person subjected to the same situation would feel the same way. It doesn't matter if the harassment is conducted face-to-face, over the phone, or in cyberspace, as long as it causes the same effect on the victim. It is harassment. Period.

You don't need to prepare a legal defense for Yan. He can simply shut up, stop harassing rainbow. I think everything will be fine.
