阿里在“討論問題還是要看CONTEXT上下文的。比如死刑”里說：“。。。你的說法就會有明顯的LOOPHOLE。。。”，顯然是簡單地誤將一種觀點的“漏洞”想當然地以為就是英文的loophole，而不知此處的“漏洞”英文詞應為flaw。蓋在英文中，此“漏洞”（ loophole）非彼“漏洞”（flaw）也。

本人好心碼字指出其謬誤，結果阿里同學辯解道：“LOOPHOLE是FLAW的一種，可泛指無法自圓其說”，聽上去好像有點道理，因為flaw作為imperfection解，起草法律條文者不當心，留有被人空子可鑽的“漏洞”，說是imperfection或flaw，倒也解釋得通。可惜這個遺憾是相對於法律制定者講的。而在英文中，loophole是相對於該法律約束者（受惠者）講的。因為法律制定者的“漏洞”，相對於該法律約束者來說，卻變成了鑽空子的“手段”（means）、“機會”（opportunity），怎麼會是遺憾涅？所以阿里的辯解，是不成立的。

阿里同學不懂的是，loophole相對的對象是被法律的約束者而不是制定者，而flaw相對的對象則是觀點的提出者。儘管中文都可譯成“漏洞”，但loophole這個“漏洞”是個機會，而flaw這個“漏洞”則是個損失或遺憾，對象不同也。

更重要的是，這兩個詞不是同義詞，不可隨便互換：loophole是不能代替flaw。所以阿里的辯解莫有用。錯就是錯列。

為了讓阿里同學更好理解，阿拉特地拔冗將詞典定義摘錄如下：

Loophole的定義為：

1. a small or narrow opening, as in a wall, for looking through, for admitting light and air, or, particularly in a fortification, for the discharge of missiles against an enemy outside. 

2. an opening or aperture.

3. a means of escape or evasion; a means or opportunity of evading a rule, law, etc.: There are a number of loopholes in the tax laws whereby corporations can save money.

Flaw的定義為：

1．An imperfection, often concealed, that impairs soundness: a flaw in the crystal that caused it to shatter. See Synonyms at blemish.

2．A defect or shortcoming in something intangible: They share the character flaw of arrogance.

Loophole同義詞為：dodge，get-out，ambiguity，excuse，escape等等。

Flaw同義詞為：fault，error，defect，mistake，failing，blemish，imperfection等等。

阿里同學仔細想想，這兩個詞有什麼共同之處捏？

最後，阿里之所以出這個洋相，也不能完全怪阿里。我想主要原因是因為loophole和flaw中文都可譯為“漏洞”。所以最終還是中文害了阿里。這就是為什麼要真正學好外語，一定要擺脫中文的拐杖。
