阿里在“讨论问题还是要看CONTEXT上下文的。比如死刑”里说：“。。。你的说法就会有明显的LOOPHOLE。。。”，显然是简单地误将一种观点的“漏洞”想当然地以为就是英文的loophole，而不知此处的“漏洞”英文词应为flaw。盖在英文中，此“漏洞”（ loophole）非彼“漏洞”（flaw）也。

本人好心码字指出其谬误，结果阿里同学辩解道：“LOOPHOLE是FLAW的一种，可泛指无法自圆其说”，听上去好像有点道理，因为flaw作为imperfection解，起草法律条文者不当心，留有被人空子可钻的“漏洞”，说是imperfection或flaw，倒也解释得通。可惜这个遗憾是相对于法律制定者讲的。而在英文中，loophole是相对于该法律约束者（受惠者）讲的。因为法律制定者的“漏洞”，相对于该法律约束者来说，却变成了钻空子的“手段”（means）、“机会”（opportunity），怎么会是遗憾涅？所以阿里的辩解，是不成立的。

阿里同学不懂的是，loophole相对的对象是被法律的约束者而不是制定者，而flaw相对的对象则是观点的提出者。尽管中文都可译成“漏洞”，但loophole这个“漏洞”是个机会，而flaw这个“漏洞”则是个损失或遗憾，对象不同也。

更重要的是，这两个词不是同义词，不可随便互换：loophole是不能代替flaw。所以阿里的辩解莫有用。错就是错列。

Loophole的定义为：

1. a small or narrow opening, as in a wall, for looking through, for admitting light and air, or, particularly in a fortification, for the discharge of missiles against an enemy outside.

Loophole同义词为：dodge，get-out，ambiguity，excuse，escape等等。

Flaw同义词为：fault，error，defect，mistake，failing，blemish，imperfection等等。

阿里同学仔细想想，这两个词有什么共同之处捏？

最后，阿里之所以出这个洋相，也不能完全怪阿里。我想主要原因是因为loophole和flaw中文都可译为“漏洞”。所以最终还是中文害了阿里。这就是为什么要真正学好外语，一定要摆脱中文的拐杖。
